Terms of Use
Saltwater Hunter ("the game") is a freediving spearfishing game for phones and tablets, made and published by Shimon Lazimi ("we", "us"). These terms apply when you download or play the game. Please read them together with our Privacy Policy.
In short: the game is free to play. One optional in-app purchase opens an expansion with more places to dive. Apple or Google sell it and handle payment and refunds. Nothing in these terms takes away the rights you have as a consumer under the law where you live.
1. The store's terms come first
You get the game from the App Store (Apple) or Google Play (Google). Their terms also apply to you: on the App Store, Apple's Licensed Application End User License Agreement; on Google Play, the Google Play Terms of Service. These terms add to them. If something here conflicts with the store's terms, the store's terms apply. Apple and Google are not responsible for the game itself; we are.
2. Your licence to play
We give you a personal, non-exclusive, non-transferable licence to install the game and play it on devices you own or control, for your own non-commercial entertainment, as the store's rules allow. You may not copy, sell, rent or redistribute the game; take apart, change or extract its code or art, except where the law allows it; cheat in leaderboards or weekly challenges by changing the game or its data; or use the game in a way that breaks the law. The game, its art, music, names and code belong to us or to those who licensed them to us.
3. The expansion (in-app purchase)
The game offers one optional, one-time in-app purchase: an expansion with more dive spots and fish (currently "Bahamas Flats & Hawaii"). The price is shown in the store's own window before you pay, in your local currency, with taxes as the store applies them. You pay Apple or Google, under their terms. Once bought, the expansion is yours to play on that store account for as long as the game is offered; you can restore it on another device with the same store account. A purchase on the App Store does not carry over to Google Play, or the other way round. The expansion is digital content supplied right away: by completing the purchase you ask for it to be supplied at once.
4. Refunds
Refunds are handled by the store you bought from, under its refund policy: on the App Store through reportaproblem.apple.com, on Google Play through your Google Play order history. We cannot issue refunds ourselves, but if something went wrong with a purchase, write to us and we will help. This does not limit any right to a remedy you have under consumer law, for example if the expansion does not work as described.
5. Game currency and progress
The money you earn inside the game (shown as "$") is part of the game. It cannot be bought for real money, has no real-world value, and cannot be exchanged, sold or withdrawn. Your progress is stored on your device (see the Privacy Policy). If you delete the game without a device backup, your progress may be lost; purchases can still be restored through the store.
6. A game, not training
Saltwater Hunter is a game. Its breath-hold, depth and fishing rules are simplified for play and are not instructions for real freediving or spearfishing. Real freediving can be deadly: never practise breath-holding in or near water alone, and learn from a certified instructor. Follow local fishing laws, protected species rules and size limits.
7. Updates and availability
We may update the game to fix faults, add content or change how it plays. Some updates may be needed to keep playing or to use the leaderboards. We will try to keep the game available, but we cannot promise it will always be offered in every store or country, or work on every device. If we ever stop offering the expansion, we will try to keep it playable for people who already bought it, for as long as the stores allow.
8. Leaderboards
The leaderboards run on Game Center (Apple) or Google Play Games (Google), under their terms. Results that are clearly impossible or come from a changed game may be removed.
9. Our responsibility
We make the game with care, but we provide it "as is", to the extent the law allows. We are not responsible for losses that we could not reasonably foresee, or that are caused by your device, your network, or by Apple's or Google's services. Nothing in these terms limits responsibility that cannot be limited by law, such as for death or personal injury caused by negligence, for fraud, or for your statutory rights as a consumer, including in the European Union and the United Kingdom.
10. Changes to these terms
We may update these terms when the game or the law changes. The date at the top shows the latest version. If a change matters to you, we will tell you in the game or on this page before it applies. If you keep playing after it applies, the new terms apply to you.
11. Law and disputes
These terms are governed by the laws of the State of Israel. If you live in the European Union, the United Kingdom or another country whose consumer law protects you, you also keep the protection of that law and may bring a claim in your local courts. Please write to us first: most problems can be solved quickly.
